AxeHouseCraft Affiliate Program Terms & Conditions

These Affiliate Program Terms and Conditions (“Terms”) govern participation in the AxeHouseCraft Affiliate Program (“Program”).

The Program is operated by Rui Machado, trading as AxeHouseCraft, established at Rua Gonçalo Velho Cabral, 2950-696. Quinta do Anjo. Palmela, Setubal, Portugal. (“AxeHouseCraft”, “we”, “us” or “our”).

By applying to, accessing or participating in the Program, you (“Affiliate”, “you” or “your”) confirm that you have read, understood and agreed to these Terms.

1. Eligibility and application

To participate in the Program, you must:

Be at least 18 years old or have reached the legal age of majority in your country;
Provide complete, accurate and current application information;
Own or legitimately control the social media accounts, website, group, community or other channels submitted in your application;
Have the legal capacity to enter into a binding agreement;
Comply with all applicable laws, platform rules and advertising requirements.

Submitting an application does not guarantee acceptance. AxeHouseCraft may approve or reject any application at its sole reasonable discretion and is not required to provide a reason.

Affiliate accounts are personal and may not be transferred, sold or shared without our prior written permission.

2. Nature of the relationship

Participation in the Program does not create an employment relationship, partnership, joint venture, franchise, agency or representative relationship between the Affiliate and AxeHouseCraft.

You act as an independent participant and have no authority to:

Enter into agreements on behalf of AxeHouseCraft;
Make commitments, guarantees or representations on our behalf;
Present yourself as an employee, agent or official representative of AxeHouseCraft;
Incur costs or liabilities in the name of AxeHouseCraft.

You are responsible for your own equipment, content, business costs, tax obligations, insurance and legal compliance.

3. Affiliate link and discount code

Approved Affiliates may receive:

A personal referral link;
A personal affiliate discount code;
Access to an affiliate portal operated through Affilitrak.

The current customer benefit is an extra 3% discount on eligible orders.

The affiliate discount may be combined only with promotions specifically designated by AxeHouseCraft as eligible. It may not necessarily combine with every sale, discount, gift card, bundle, subscription or promotional offer.

AxeHouseCraft may change, pause or withdraw the customer discount at any time. Changes will not affect orders already completed before the change.

Affiliate codes and links remain the property of AxeHouseCraft and may be disabled, renamed or replaced when reasonably necessary.

4. Affiliate rewards

The current Affiliate reward is 5% of Eligible Net Sales, issued exclusively as AxeHouseCraft store credit.

Although Affilitrak may use terms such as “commission”, “earnings”, “balance” or “payout”, no cash payment is offered under this Program.

Affiliate rewards:

Cannot be withdrawn as cash;
Cannot be transferred to another person;
Cannot be sold or exchanged;
Do not earn interest;
Cannot be used to purchase gift cards unless expressly authorised;
May only be used on eligible AxeHouseCraft purchases;
Are not a bank deposit, cash account or financial product.

AxeHouseCraft may require the Affiliate to have a customer account using the same verified email address before store credit can be issued.

5. Eligible Net Sales

“Eligible Net Sales” means the eligible product subtotal actually paid by a referred customer, after discounts and promotional reductions.

Unless AxeHouseCraft expressly states otherwise, rewards are not calculated on:

VAT, sales tax or similar taxes;
Shipping charges;
Customs duties or import charges;
Tips, donations or optional contributions;
Gift cards;
Cancelled or unpaid orders;
Refunded or partially refunded amounts;
Chargebacks or fraudulent transactions;
Purchases made by the Affiliate;
Orders that violate these Terms;
Orders that cannot be reliably attributed to the Affiliate.

If an order is partially refunded, the reward may be recalculated. If it is fully refunded, cancelled or charged back, the related reward and milestone order may be removed.

6. Attribution of referrals

A referral qualifies only when Affilitrak, Shopify or AxeHouseCraft’s internal records successfully attribute the order to the Affiliate’s approved link or code.

Tracking may be affected by:

Cookie restrictions;
Ad blockers;
Browser privacy settings;
Customers changing devices or browsers;
Customers clearing cookies;
The use of another Affiliate’s link or code;
Technical interruptions outside our reasonable control.

AxeHouseCraft does not guarantee that every click, visit or order will be tracked.

Where attribution records conflict, AxeHouseCraft may use the information available from Shopify, Affilitrak, discount-code records and other reasonable evidence to determine attribution. AxeHouseCraft’s good-faith determination will be final, subject to correction of clear technical or administrative errors.

7. Approval of orders and issue of credit

Rewards remain pending until AxeHouseCraft confirms that an order is:

Fully paid;
Legitimate;
Properly attributed;
Not cancelled;
Not refunded or charged back;
Outside any relevant verification or review period;
Compliant with these Terms.

Store credit is normally issued periodically after orders are approved. AxeHouseCraft may delay approval where there is suspected fraud, an open dispute, a payment investigation, an unusually high return risk or a technical attribution issue.

Pending amounts are not guaranteed rewards and cannot be used until approved and issued.

8. Free Diamond Painting milestone reward

For every 15 Approved Referral Orders, the Affiliate becomes eligible for one free selected Diamond Painting.

This milestone repeats after 15, 30, 45, 60 and subsequent sets of 15 Approved Referral Orders, unless the Program is changed or discontinued.

For this purpose:

One customer order counts as one order, regardless of the number of items purchased;
Cancelled, refunded, fraudulent, unpaid or self-referred orders do not count;
Orders removed after a refund or chargeback may reduce the Affiliate’s milestone total;
The reward is separate from the 5% store-credit reward.

The free Diamond Painting:

Must be selected from the products, sizes and options made available by AxeHouseCraft;
Is subject to stock and production availability;
Cannot be exchanged for cash or additional store credit;
Cannot be transferred or resold as an Affiliate reward;
May exclude limited editions, subscriptions, Grand Masterpieces, custom products or other designated products;
Must normally be claimed within 90 days of notification.

AxeHouseCraft may choose the shipping method. Import duties, local taxes, remote-area surcharges or other destination-specific charges may remain the Affiliate’s responsibility.

9. Self-referrals and related purchases

Affiliates may not earn rewards through their own purchases.

The following may be treated as prohibited self-referrals:

Orders using the Affiliate’s own name, email address or customer account;
Orders using the Affiliate’s own payment method;
Orders delivered to the Affiliate’s address;
Orders placed through another person for the Affiliate’s benefit;
Coordinated orders intended primarily to generate rewards;
Duplicate, fictitious or related accounts created to avoid this rule.

Legitimate referrals from family members or household members may be reviewed manually and may be rejected where AxeHouseCraft cannot reasonably verify that they are genuine independent customers.

10. Advertising disclosure

Every Affiliate must clearly disclose their commercial relationship with AxeHouseCraft whenever publishing an affiliate link, affiliate code, product received for free, store-credit reward or other promotional content.

The disclosure must be:

Clear and easy to understand;
Visible before or at the beginning of the promotional content;
Presented in the same language as the content;
Suitable for the platform being used;
Not hidden among hashtags, links, expandable text or lengthy captions.

Appropriate disclosures may include:

“Ad”
“Advertisement”
“Affiliate link”
“I earn AxeHouseCraft store credit from qualifying purchases”
“Gifted by AxeHouseCraft”, where relevant

Using vague wording such as “collab”, “partner”, “thanks to” or “support me” may not be sufficient on its own.

The Affiliate is responsible for following the advertising rules applicable to their audience and location, including platform-specific branded-content tools.

11. Content standards

Affiliate content must be honest, accurate and based on genuine experience.

Affiliates must not:

Make false, misleading or unsubstantiated claims;
Misrepresent product materials, specifications, availability or delivery times;
Guarantee results or customer satisfaction;
Claim that a promotion is exclusive when it is not;
Create false urgency, scarcity or countdowns;
Publish fake reviews or fabricated customer experiences;
Conceal that content is advertising;
Misrepresent the value or availability of discounts;
Alter product images in a way that materially misrepresents the product;
Make medical, therapeutic or health claims about our products;
Publish discriminatory, hateful, violent, sexually explicit, illegal or otherwise harmful content in connection with AxeHouseCraft.

Prices, promotions and availability may change. Affiliates should direct customers to the AxeHouseCraft website for current information.

12. Prohibited promotional methods

Without prior written permission from AxeHouseCraft, Affiliates may not:

Purchase paid-search advertisements using “AxeHouseCraft”, its misspellings, product names or other protected brand terms;
Bid on AxeHouseCraft trademarks through Google Ads, Bing Ads or similar services;
Use AxeHouseCraft in a domain name, social-media username, page name or app name;
Impersonate AxeHouseCraft or create pages that could be mistaken for official pages;
Use paid advertising that links directly to AxeHouseCraft;
Publish codes on coupon, voucher, discount or cashback websites;
Use browser extensions, toolbars, pop-ups or automatic code-injection tools;
Use cookie stuffing, forced clicks, hidden redirects or misleading links;
Send unsolicited commercial email, text messages or direct messages;
Buy followers, clicks, traffic, orders or engagement;
Create fake accounts, fake orders or artificial referrals;
Promote through illegal websites or channels that infringe third-party rights;
Resell or distribute Affiliate links or codes to unauthorised sub-affiliates.

Organic sharing in genuine social-media posts, videos, streams, blogs, websites, groups and communities is permitted, provided it complies with these Terms.

13. Brand assets and intellectual property

AxeHouseCraft grants approved Affiliates a limited, revocable, non-exclusive, non-transferable licence to use approved logos, product images and marketing materials solely to promote AxeHouseCraft under this Program.

Affiliates may not:

Claim ownership of AxeHouseCraft intellectual property;
Register confusingly similar trademarks, domains or usernames;
Remove copyright, trademark or attribution notices;
Materially alter logos;
Use outdated promotional material after being asked to remove it;
Use third-party artwork or content without appropriate permission.

All rights not expressly granted remain with AxeHouseCraft or the relevant rights holder.

Affiliate-created content remains the Affiliate’s property. Where an Affiliate sends content to AxeHouseCraft for reposting or expressly tags AxeHouseCraft for promotional reuse, the Affiliate grants AxeHouseCraft a non-exclusive, worldwide, royalty-free licence to repost that content on its website, emails and social channels, with attribution where reasonably practical.

14. Monitoring and compliance

AxeHouseCraft may review Affiliate websites, social channels and promotional activity to verify compliance.

We may request:

Links to promotional content;
Screenshots;
Proof of disclosure;
Traffic information;
Clarification about unusual orders;
Removal or correction of non-compliant content.

Affiliates must cooperate within a reasonable period. Failure to correct content may result in suspension or termination.

15. Suspension, rejection and termination

Either party may end participation in the Program at any time.

AxeHouseCraft may immediately suspend or terminate an Affiliate where we reasonably suspect:

Fraud or attempted fraud;
Self-referrals;
Misleading advertising;
Brand impersonation;
Spam;
Unauthorised paid advertising;
Coupon-site distribution;
Manipulation of tracking;
Repeated customer complaints;
Breach of intellectual property rights;
Breach of these Terms;
Conduct that may damage AxeHouseCraft’s reputation or customers.

On termination:

Affiliate links and codes may be disabled immediately;
The Affiliate must stop using AxeHouseCraft brand assets;
Pending, unapproved or fraud-related rewards may be cancelled;
Approved and undisputed store credit already issued will remain subject to its original conditions, unless obtained through fraud or material breach;
No further orders will qualify after the effective termination time.

Termination does not prevent AxeHouseCraft from seeking recovery of losses caused by fraud, unlawful conduct or material breach.

16. Changes to the Program

AxeHouseCraft may change:

Reward percentages;
Customer discounts;
Eligible products;
Promotion-combination rules;
Milestone rewards;
Approval periods;
Attribution methods;
Program features;
These Terms.

Where reasonably practical, material changes will be communicated through email, the affiliate portal or the AxeHouseCraft website.

Changes will apply prospectively and will not retroactively reduce rewards already approved, except where necessary to correct an error, refund, chargeback, fraud or legal violation.

Continued participation after a change takes effect constitutes acceptance of the updated Terms.

17. Taxes and legal obligations

The Affiliate is solely responsible for determining whether store credit, free products or other rewards must be declared for tax, accounting, customs or other legal purposes.

AxeHouseCraft does not provide tax or financial advice.

Where required by law, AxeHouseCraft may request identity, tax or business information and may withhold rewards until the required information is provided.

18. Personal data

Personal data collected through the Program may include identification details, contact information, social-media information, customer-account email, referral activity, order attribution and reward history.

It will be processed for purposes including:

Assessing applications;
Administering Affiliate accounts;
Tracking referrals;
Preventing fraud;
Calculating and issuing rewards;
Communicating Program information;
Complying with legal obligations.

Program data may be processed through service providers including Shopify and Affilitrak.

Personal data will be handled in accordance with the AxeHouseCraft Privacy Policy and applicable data-protection law.

Affiliates must not collect, store or use customer personal data obtained through the Program unless expressly authorised and legally permitted. Customer names, emails and order details must not be copied, shared or used for independent marketing.

19. Confidentiality

Affiliates must keep non-public information confidential, including:

Unreleased products;
Private discount structures;
Internal sales information;
Customer information;
Security information;
Non-public campaign plans;
Materials identified as confidential.

This obligation continues after leaving the Program.

20. No guarantee

AxeHouseCraft does not guarantee:

Acceptance into the Program;
Any particular level of traffic, sales or rewards;
Continuous availability of the website, Affilitrak or tracking services;
That every referral will be successfully tracked;
That products or promotions will remain available;
Any minimum duration of the Program.

Participation is at the Affiliate’s own commercial risk.

21. Limitation of liability

To the maximum extent permitted by law, AxeHouseCraft will not be liable for indirect, incidental, special or consequential loss, including loss of profit, audience, data, opportunity or anticipated rewards arising from participation in the Program.

AxeHouseCraft’s total liability arising from the Program will not exceed the value of approved Affiliate rewards earned during the three months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, gross negligence, death or personal injury where applicable.

22. Indemnification

To the extent permitted by law, the Affiliate agrees to compensate and hold AxeHouseCraft harmless from third-party claims, penalties, losses and reasonable costs arising from:

The Affiliate’s unlawful or misleading content;
Failure to disclose advertising;
Infringement of intellectual property or privacy rights;
Spam or unauthorised marketing;
Breach of these Terms;
Fraudulent or negligent conduct by the Affiliate.

23. Governing law

These Terms are governed by the laws of Portugal.

The courts of Portugal will have jurisdiction over disputes relating to the Program, without prejudice to any mandatory legal rights or jurisdiction rules that cannot lawfully be excluded.

Before starting formal proceedings, both parties should attempt to resolve the dispute in good faith by contacting axehousecraft@thinklater.shop.

24. General provisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

Failure by AxeHouseCraft to enforce a provision does not waive the right to enforce it later.

The Affiliate may not assign or transfer their rights or obligations without prior written consent.

These Terms, together with the applicable Program information, Privacy Policy and any written campaign-specific rules, constitute the entire agreement relating to participation in the Program.

The English version of these Terms will prevail where a translated version contains an inconsistency.
